Senator TATE (Minister for Justice)(10.29) —I do not think we are going to have a vote on this before we adjourn. Do we want to negative the adjournment?


Senator Peter Baume —I do not think so.


Senator TATE —I would just say, in answer to Senator Tambling, that it is a non sequitur in my view and he really should look at clause 3 (d) again, where quite clearly in the objectives clause it is made clear that in furthering the situation of the Aboriginal and Torres Strait Islander peoples, there is nothing that should detract from the responsibilities of State, Territory and local government to provide services to their Aboriginal and Torres Strait Islanders. I think one has to keep re-emphasising that: that responsibilities are still very much on the shoulders of those levels of government, constituted as they are under our federal system, and that it is only by agreement with those levels of government that the sort of payments we are talking about under clause 2 (b) can be made.
