Senator COATES —I give notice that, 12 sitting days after today, I shall move:

(1) That Amendment No. 43 of the Telecommunications (General) By-laws, made on 10 July 1985 under the Telecommunications Act 1975, be disallowed;

(2) That Amendment No. 44 of the Telecommunications (General) By-laws, made on 14 August 1985 under the Telecommunications Act 1975, be disallowed.

I seek leave, Mr President, to make a brief statement about those two matters.

Senator COATES —Both these by-laws appear to give Telecom Australia discretionary powers to make administrative decisions which could be of considerable commercial significance to suppliers and subscribers. The discretions are not subject to any appeal procedures, and the Committee has asked Telecom for its comments on making these decisions subject to merits review. The Committee is holding a hearing this week to discuss the issues with representatives of the Australian Telecommunications Commission. Pending resolution of the matters, I have given notice of motion to protect the Committee's freedom of action.
