Senator GIETZELT —I would like to expand on my response to a question from Senator Macklin yesterday regarding the Repatriation Review Tribunal. Senator Macklin, in his question, correctly observed that legal practitioners are barred from appearing as advocates before the various levels of the determining system, and asked whether the First Assistant Secretary, Legal Services, is legally qualified, and whether he has appeared before the Repatriation Review Tribunal. I am advised that he does in fact have a law degree and has appeared before the Tribunal. However, he is not a legal practitioner, and the Tribunal has accepted that he is therefore entitled to appear before it. Moveover, none of the other Commission advocates are legal practitioners and, in fact, most are lay persons with no formal legal qualifications.
