Mr DUGALD THOMSON (NORTH SYDNEY, NEW SOUTH WALES) . - I notice that the penalties provided under this Bill are somewhat varied.

Mr Groom - The penalty under this clause is the same as that provided by the English Act.

Mr DUGALD THOMSON (NORTH SYDNEY, NEW SOUTH WALES) - The Minister follows the English Act when he chooses to do so. There is provision in the Bill for a penalty of £50, and for a punishment of three years' imprisonment.

Mr Groom - That is in relation to a very serious offence for which provision is made in the English Act. The honorable member will find that most of these penalties are taken from the English statute.

Mr DUGALD THOMSON (NORTH SYDNEY, NEW SOUTH WALES) - Does the continuance of the infringement of a design allow of a repetition of the penalty?

Mr Groom - The offender is liable to an injunction to restrain, and every time he knowingly commits the offence he is liable to a penalty.


Mr Groom - Yes, and also to an injunction.
