Senator COULTER (11.25 a.m.) —This arises because of the somewhat different structure of this bill. The preamble anticipates certain things in the bill itself. If one is going to move the amendments in the bill, one has to change the preamble and vice versa. But I would like to simply have on the record that there is no chance these are going to be accepted. I just want to have on the record that these amendments have been rejected. I think Senator Chamarette is in the same position.

2.Clause 7, page 4, line 6, after "the Agreement," insert "as modified in the way described in the last paragraph of the Preamble,"

3.Clause 17, pages 7 and 8, lines 31 to 40 (page 7) and lines 1 to 14 (page 8) omit the clause, substitute the following clause:

Council to prepare draft of proposed measure

  "17. Before making any national environment protection measure and not earlier than 30 days after the day on which paragraph 16(2)(b) has been fully complied with in all participating jurisdictions, the Council must prepare a draft of the proposed measure.".

4.Clause 18, page 8, lines 15 to 21, omit subclause (1), substitute the following subclause:

Public consultation

"18.(1)  Before making a national environment protection measure, the Council must publish a notice:

      (a)stating how the draft of the proposed measure may be obtained; and

      (b)inviting submissions to the Council on the proposed measure within a specified period.".

5.Clause 19, page 8, lines 31 to 38, omit the clause, substitute the following clause:

Council to have regard to submissions

"19.  In making a national environment protection measure, the Council is to have regard, in addition to the matters referred to in section 15, to:

      (a)any submissions it receives that relate to the measure; and

      (b)any advice from the NEPC Committee or from a committee established under section 33.".

6.Clause 21, page 9, lines 33 to 39, omit subclause (2), substitute the following subclause:

"(2)  A national environment protection measure laid before a House of the Parliament in accordance with section 46A of the Acts Interpretation Act 1901 must be accompanied by:

      (a)a summary of the submissions received by the Council in relation to the measure; and

      (b)the Council's responses to those submissions.".
