Senator KERNOT (Leader of the Australian Democrats) —I give notice that, on the next day of sitting, I shall move:

  (1)That, in the light of the statement on 18 August 1994 to the Standing Committee of Privileges by the Leader of the Government in the Senate (Senator Gareth Evans) that `we have frankly conceded often enough that the power is there' for the Senate to recover documents from Government agencies, and for the reason set out in paragraph (2), there be laid on the table by the Minister representing the Treasurer (Senator Cook), not later than immediately after question time and any motions to take note of answers to questions on 31 August 1994, with respect to each of the documents which the Treasurer or his officials provided to Mr Justice Sheppard in the Federal Court of Australia on 18 July 1994 in relation to the Independent Newspaper plc and the Australian Independent Newspaper consortium claim against the Fairfax group, its former receivers and their advisers, the following information:

    (a)date of origination of document;

    (b)name of originator;

    (c)name of recipient;

    (d)subject matter; and

    (e)whether the document has been provided to the Select Committee on Certain Aspects of Foreign Ownership Decisions in relation to the Print Media.

  (2)The reason referred to in paragraph (1) is that the Senate has a right to any information which indicates the extent to which the executive is prepared to make a distinction between the Parliament and the judiciary in relation to the provision of documents.
