Senator SPINDLER (8.28 p.m.) —I move:

11.Clause 4, page 12, before proposed subsection 3P(1), insert the following subsection:

"`(1A) In this section, "issuing officer" means a magistrate.".

The amendment seeks to ensure that telephone warrants are issued only by magistrates. The decision to infringe a person's liberty and privacy is a serious one. In the case of warrants issued by telephone or other electronic means the safeguards for the use of the search powers are greatly reduced. Such warrants should be granted only by those fully trained in the consideration of evidence and the determination of questions of law. I believe it is important to limit the granting of telephone warrants to magistrates only.
