Senator TATE —by leave-The Select Committee on Allegations Concerning a Judge has met and elected me chairman, and I make this statement on behalf of the Committee. The Committee has considered the letter of 10 September 1984 from the Director of Public Prosecutions, Mr Ian Temby Q.C, which was referred to the Committee by the Senate on that day.

It is the view of the Committee that the Committee should conduct its inquiry and make its report to the Senate, and that the Senate should then consider whether any of the evidence or documents of the Select Committee on the Conduct of a Judge or of this Committee should be referred to Mr Temby for examination, and accordingly the material referred to in the Senate's resolution of 6 September 1984 should not be forwarded to Mr Temby in accordance with that resolution.

The Committee recommends that the resolution of 6 September 1984 be appropriately treated to conform with the course of action which the Committee suggests.
