PETROLEUM RETAIL MARKETING SITES AMENDMENT BILL 1982 [1983]

The Senate, according to Order, resolved itself into Committee for the further consideration of the Bill.

In the Committee

Consideration resumed of the Bill and of the amendment moved thereto by Senator Gareth Evans, viz: Page 1, clause 3, leave out the clause, insert the following clause: Restrictions on operation of retail sites ''3. Section 10 of the Principal Act is amended by adding at the end of sub-section (3):

'and if the corporation does not take advantage of the power it has, in relation to the market for the retail sale of motor fuel, for the purpose of eliminating or substantially damaging a person, being a competitor in that market of the corporation or its agents or of a body corporate related to the corporation'.''.

Amendment, by leave, withdrawn.

On the motion of the Leader of the Australian Democrats (Senator Chipp) the following amendment was debated and agreed to: Clause 3, leave out '' 'and before 1 July 1983' '', insert '' 'and before 1 January 1984' ''.

Question-That the Bill, as amended, be agreed to-put.
