Senator LUNDY (Australian Capital TerritoryMinister Assisting for Industry and Innovation, Minister for Multicultural Affairs and Minister for Sport) (20:10): I think I responded to this question in substance when I first spoke to this amendment. We believe firmly that the agreement can contain the sorts of measures as outlined and that it will be subject to the scrutiny of parliament. The other point I made to Senator Milne, through you Mr Temporary Chairman, is that to create openings that would allow for High Court challenges to the legislation to occur would render it unworkable, and we believe that in fact the appropriate test is withstanding the scrutiny of parliament. We have been through in detail what that process is.
