Senator FIFIELD (VictoriaManager of Government Business in the Senate and Minister for Communications and the Arts) (12:20): I want to check I am understanding Senator Siewert's question correctly. Senator Siewert, you were asking why the secretary doesn't have to satisfy himself that there isn't some adverse personal effect on an individual before they're subject to participation in the trial. Is that correct?

Senator Siewert: Yes.

Senator FIFIELD: The government's view would be that the starting point and assumption should not be, and isn't, that the trial and participation in it is to the detriment of an individual or that it restricts their human rights, so I think we're starting from a different point of embarkation, if you like.
