Senator Cormann asked the Minister representing the Minister for Health and Ageing, upon notice, on 19 May 2009:

(1)   With reference to any genetic test or biopharmaceutical, has the department ever considered applying for a compulsory license under section 133 of the Patents Act 1990; if so, can details be provided identifying the test or biopharmaceutical and the respective patent or patents applying thereto.

(2)   Was any application by the department for a compulsory license successful; if so, can details be provided in order to identify the application and an accurate summary of the terms of the compulsory license; if not, can an explanation be provided in relation to each unsuccessful application.
