Senator BELL —I give notice that, on the next day of sitting, I shall move:

  That the Senate—

  (a)notes that, in a Hobart Court on 10 May 1994, Mr Robert Cumming claimed self defence against charges of defacing posters advertising tobacco products, supported by evidence submitted that cigarette smoke in the environment was a particularly aggressive irritant to asthmatics; and

  (b)calls on the Minister for Human Services and Health (Dr Lawrence) to ensure that the Commonwealth is not legally liable for any adverse effects of tobacco smoke in the environment on people suffering from asthma.
