I refer my friends in the coalition to the Senate Standing Committee on Economics report, The need, scope and content of a definition of unconscionable conduct for the purposes of part IVA of the Trade Practices Act 1974. It is a December 2008 report—it is amazing to think that three years have passed so quickly. There are additional comments made by both the coalition and myself about the need for a statutory definition of unconscionable conduct. I am pleased that the coalition took that view at that time and I hope it is still their view.

Notwithstanding that, I want to get to the nub of the issues of the specific amendments proposed by the government. Does the government expect that there will be more cases brought to court as a result of these amendments to the definition of unconscionable conduct?
