Commonwealth Functions (Statutes Review) Act 1981: Section 215

Report on the operations of the Legislative Drafting Institute during the period 1 July 1981 to 8 Decem ber 1981

INTRODUCTION

Sections 212 and 215 of the Commonwealth Functions (Statutes Review) Act 1981 read as follows:

Repeal

212. The Legislative Drafting Institute Act 1974 is repealed. ’

‘Report on operations of Institute

215. The Attorney-General shall, as soon as practicable after the commencing day, cause to be prepared a report of the operations of the Institute during the period that commenced at the expiration of the last period in respect of which a report of the operations of the Institute was furnished to the Attorney-General and ended immediately before the commencing day (in section 216 referred to as the “relevant period”), together with financial statements in

respect of that period in such form as the Minister for Finance approves.’

By sub-section 2(1) of that Act those sections and related sections were to come into operation on a date to be proclaimed. By Proclamation published in the Gazette on 8 December 1981, those sections were proclaimed to come into operation on 9 December 1981.

The Seventh Annual Report presented by the Legislative Drafting Institute covered the operations of the Institute from 1 July 1980 to 30 June 1981. That Report was tabled in both Houses of the Parliament on 22 October 1981. This Report has been prepared in accordance with section 215 of the Commonwealth Functions (Statutes Review) Act 1981.

THE OPERATIONS OF THE INSTITUTE

The 1981 course of training for legislative draftsmen commenced on 11 March 1981 and concluded on 11 November 1981. Particulars of the course program and of the persons attending the course are set out in the Seventh Annual Report of the Institute referred to above. No purpose will be served by repeating those particulars. The

Seventh Annual Report also contained a summary of the training provided by the Institute in the years 1975 to 1981.

FINANCE

Section 216 of the 1981 Act provides that the Attorney-General shall cause the financial statements prepared in accordance with section 215 to be submitted to the Auditor-General who will report to the Attorney-General. The financial statements in respect of the period covered by the Report and in the form approved by the Minister

for Finance have been submitted to the Auditor-General. A copy of the Auditor- General’s Report together with the financial statements is attached.

In accordance with section 216 of the Commonwealth Functions (Statutes Review) Act 1981, the financial statements of the Institute comprising a Statement of Receipts and Payments, a Statement of Assets and Liabilities and a Statement of Balance Day Adjustments for the period 1 July 1981 to 8 December 1981 have been submitted for my report. A copy of the Statements which are in the form approved by the Minister for Finance is attached for your information.

I now report that the accompanying financial statements are in agreement with the accounts and records of the Institute and in my opinion: (a) the statements are based on proper accounts and records; and (b) the receipt, expenditure and investment of moneys and the acquisition and

disposal of assets by the Institute during the relevant period were in accordance with the repealed Act.
