THE STUDENT ASSISTANCE ACT 1973

The S t u d e n t A s s i s t a n c e A c t came i n t o o p e r a t i o n on 15 O c t o b e r 1 9 7 4 . I t

p r o v i d e s t h e l e g i s l a t i v e b a s i s f o r t h e g r a n t i n g o f f i n a n c i a l a s s i s t a n c e

t o s t u d e n t s , who a r e A u s t r a l i a n c i t i z e n s o r p e r m a n e n t r e s i d e n t s o f

A u s t r a l i a , u n d e r T e r t i a r y E d u c a t i o n A s s i s t a n c e ( P a r t I I I o f t h e A c t) a n d

P o s t g r a d u a t e A w ards ( P a r t IV o f t h e A c t ) .

The p r o v i s i o n s o f t h e Act a r e i n b r o a d t e r m s a n d a l l o w f o r t h e m a k in g o f

STUDENT ASSISTANCE TO WHICH THE ACT APPLIES

TERTIARY EDUCATION ASSISTANCE

The T e r t i a r y E d u c a t i o n A s s i s t a n c e Scheme (TEAS) p r o v i d e s a s s i s t a n c e on a

n o n - c o m p e t i t i v e b a s i s f o r A u s t r a l i a n s t u d e n t s u n d e r t a k i n g f u l l - t i m e s t u d y

i n a p p r o v e d c o u r s e s a t u n i v e r s i t i e s , c o l l e g e s o f a d v a n c e d e d u c a t i o n , TAPE

c o l l e g e s and c e r t a i n o t h e r a p p r o v e d t e r t i a r y e d u c a t i o n i n s t i t u t i o n s i n

A u s t r a l i a . L i v i n g a l l o w a n c e a s s i s t a n c e i s s u b j e c t t o c e r t a i n c o n d i t i o n s

o f a c a d e m ic e l i g i b i l i t y w h ic h t a k e i n t o a c c o u n t a s t u d e n t ' s p e r f o r m a n c e

i n d e p e n d e n t s t a t u s h a v e a means t e s t a p p l i e d t o t h e in c o m e o f t h e i r

S t u d e n t s who q u a l i f y f o r p a y m e n t o f l i v i n g a l l o w a n c e a r e a l s o g r a n t e d a n

i n c i d e n t a l s a l l o w a n c e t o a s s i s t i n m e e t i n g e x p e n s e s s u c h a s s t u d e n t

r e p r e s e n t a t i v e c o u n c i l , u n i o n a n d s p o r t s f e e s . D e p e n d a n t s a l l o w a n c e s i n

r e l a t i o n t o s p o u s e and c h i l d r e n , and f a r e s a l l o w a n c e a r e a l s o p a y a b l e i n

c e r t a i n c i r c u m s t a n c e s . The o p e r a t i o n o f t h e means t e s t i s d e s c r i b e d i n

t h e 1974 R e p o r t , and t h e 1976 R e p o r t s e t s o u t t h e c i r c u m s t a n c e s u n d e r

w h ic h i n d e p e n d e n t s t a t u s may be g r a n t e d . The 1978 R e p o r t p r o v i d e s an

a n a l y s i s o f t h e c h a r a c t e r i s t i c s o f g r a n t e e s u n d e r t h e s c h e m e .

1 9 8 1 . The m eans t e s t on p a r e n t a l in c o m e was r e l a x e d by r a i s i n g t h e l e v e l

o f a d j u s t e d f a m i l y in com e a t w h i c h maximum b e n e f i t s a r e p a i d f ro m $ 9 , 4 0 0

t o $ 1 0 , 3 1 2 . The c u t - o f f p o i n t s f o r r e c e i p t o f a l l o w a n c e s w e r e a s a

r e s u l t , i n c r e a s e d t o $ 1 5 , 7 2 1 f o r a s t u d e n t l i v i n g a t home a n d t o $ 1 9 , 3 6 1

f o r a s t u d e n t l i v i n g away f r o m home. The l i m i t o f s p o u s e incom e a t w h ic h

maximum b e n e f i t s a r e p a y a b l e w as a l s o i n c r e a s e d f r o m $ 9 , 4 0 0 t o $ 1 0 , 3 1 2 ,

w i t h t h e c u t - o f f p o i n t i n c r e a s i n g f r o m $ 1 3 , 4 9 7 t o $ 1 4 , 8 7 9 ( t h e c u t - o f f

p o i n t s v a r y , a s b e t w e e n p a r e n t a l and s p o u s e in c o m e , b e c a u s e t h e a b a t e m e n t

r a t e s d i f f e r ) .

The m eans t e s t on a s t u d e n t ' s p e r s o n a l income was r e l a x e d t o a l l o w

s t u d e n t s t o e a r n up t o $ 2 , 0 0 0 i n t h e y e a r o f s t u d y , i n c l u d i n g up t o $500

f ro m a n o t h e r a w a r d , b e f o r e a f f e c t i n g t h e i r l i v i n g a l l o w a n c e e n t i t l e m e n t .

The p r e v i o u s l i m i t s w ere $ 1 , 5 0 0 and $150 r e s p e c t i v e l y .

The m eans t e s t f o r t h e p a y m e n t o f d e p e n d e n t s p o u s e a l l o w a n c e was a l s o

c h a n g e d f o r 1981 t o p e r m i t t h e a l l o w a n c e t o be p a i d i n any week i n w h ic h

t h e s p o u s e ' s in com e f ro m e m p l o y m e n t , bank i n t e r e s t o r o t h e r i n v e s t m e n t s

d i d n o t e x c e e d $ 3 0 . P r e v i o u s l y t h e r e w ere s e p a r a t e l i m i t s on in com e f ro m

em p lo y m e n t and i n t e r e s t o r i n v e s t m e n t s .

L i v i n g a l l o w a n c e s w ere a l s o r a i s e d f ro m t h e b e g i n n i n g o f 1 9 8 1 . The

maximum a t home r a t e o f l i v i n g a l l o w a n c e was i n c r e a s e d fro m $ 1 , 5 2 3 t o

$ 1 , 6 7 5 a y e a r w h i l e t h e maximum away f ro m home an d i n d e p e n d e n t r a t e s w e r e

i n c r e a s e d f ro m $ 2 , 3 4 8 t o $ 2 , 5 8 3 a y e a r .

T h e r e was a l s o a n i n c r e a s e i n t h e d e p e n d e n t s p o u s e a l l o w a n c e fro m $ 3 1 . 4 0

t o $ 4 2 . 7 0 a w eek, and d e p e n d e n t c h i l d a l l o w a n c e f r o m $ 7 . 5 0 t o $10 a w eek.

I n t h e 1 9 8 1 - 8 2 B u d g e t , a n i n c r e a s e was a n n o u n c e d i n t h e l e v e l o f a d j u s t e d

f a m i l y incom e an d o f s p o u s e i n c o m e a t w h ich maximum b e n e f i t s a r e p a i d

from $ 1 0 , 3 1 2 i n 1981 t o $ 1 1 , 0 3 4 i n 1982. T h e s e c h a n g e s a r e p r o v i d e d f o r

i n S t a t u t o r y R u l e s 1981 No. 3 4 1 .

I n A p r i l 1 9 8 1 , t h e P rim e M i n i s t e r a n n o u n c e d t h r e e m o d i f i c a t i o n s i n TEAS

e l i g i b i l i t y c o n d i t i o n s f o l l o w i n g t h e R eview o f Commonwealth F u n c t i o n s :

(a) s t u d e n t s i n t h e 21 t o 25 y e a r s a g e g r o u p w o u ld no l o n g e r be e l i g i b l e

on t h e s c o r e o f a g e a l o n e f o r a s s i s t a n c e a t t h e away f r o m home r a t e ;

(b) p a r t i c i p a t i o n i n a de f a c t o r e l a t i o n s h i p w o u ld no l o n g e r q u a l i f y an

a p p l i c a n t f o r i n d e p e n d e n t s t a t u s ; and (c) p e r i o d s o f r e g i s t r a t i o n f o r

e m p lo y m e n t w h ic h do n o t i n v o l v e t h e r e c e i p t o f u n em p lo y m e n t b e n e f i t may

be t a k e n i n t o a c c o u n t i n d e t e r m i n i n g t h e two y e a r q u a l i f y i n g p e r i o d f o r

i n d e p e n d e n t s t a t u s . The new p r o v i s i o n s a r e e f f e c t i v e f ro m 1 J a n u a r y 1982

b u t s t u d e n t s who had p r e v i o u s l y q u a l i f i e d u n d e r t h e r u l e s w h ic h h a v e b e e n

m o d i f i e d w i l l c o n t i n u e t o do s o . S t a t u t o r y R u l e s 1981 No. 341 p r o v i d e s

f o r t h e s e c h a n g e s .

S t a t u t o r y R u l e s 1981 No. 23 r e d e f i n e s minimum w o r k l o a d r e q u i r e m e n t s f o r

u n d e r g r a d u a t e c o u r s e s o f f e r e d by M a c q u a r i e U n i v e r s i t y . S t a t u t o r y R u l e s

1981 No. 61 p r o v i d e s t h a t an a p p l i c a n t who h a s u n d e r t a k e n s i x m o n th s

s t u d y t o w a r d s a M a s t e r s o r D o c t o r s d e g r e e o u t s i d e A u s t r a l i a i s i n e l i g i b l e

f o r TEAS. S t a t u t o r y R u l e s 1981 No. 62 p r o v i d e s f o r i n c l u s i o n i n g r o s s

in com e f o r p u r p o s e s o f t h e m eans t e s t o f a l l incom e c o v e r e d by s e c t i o n 26

o f t h e Income Tax A s s e s s m e n t A c t 1936 and amends p r e v i o u s r e f e r e n c e s t o

g r o s s in c o m e . S t a t u t o r y R u l e s 1981 No. 117 am ends t h e l i s t o f

o b l i g a t i o n s o f TEAS g r a n t e e s i n l i n e w i t h t h o s e l i s t e d i n t h e

" I n f o r m a t i o n f o r A p p l i c a n t s " b o o k l e t . S t a t u t o r y R u l e s 1981 No. 386

p r o v i d e s f o r p h a s i n g o u t o f a s s i s t a n c e a t t h e M elba M e m o ria l

C o n s e r v e t o r i u m o f M u s i c , d e l e t e s a r e f e r e n c e t o r e g u l a t i o n 43C ( r e p e a l e d

i n 1979) and r e p e a l s s u b - r e g u l a t i o n 4 5 (7 ) and 4 5 B (5) w h ic h h a d e f f e c t

o n l y i n 1978 i n New S o u t h W a le s and t h e A u s t r a l i a n C a p i t a l T e r r i t o r y .

POSTGRADUATE AWARDS

T h i s scheme p r o v i d e s c o m p e t i t i v e Awards f o r s t u d e n t s u n d e r t a k i n g h i g h e r

d e g r e e s t u d i e s by r e s e a r c h o r c o u r s e work a t A u s t r a l i a n u n i v e r s i t i e s and

c o l l e g e s o f a d v a n c e d e d u c a t i o n . The p r i m a r y p u r p o s e o f t h e schem e i s t o

s t r e n g t h e n and d e v e l o p t h e p o s t g r a d u a t e a n d r e s e a r c h s c h o o l s , t o e n s u r e a

f l o w o f h i g h l y t r a i n e d p e r s o n n e l i n t o t h e work f o r c e a n d t o p r o v i d e more

t a l e n t e d s t u d e n t s w i t h t h e o p p o r t u n i t y f o r f u l l i n t e l l e c t u a l d e v e l o p m e n t .

( i i ) C o u r s e Awards

C o u r s e Awards a r e g r a n t e d t o s t u d e n t s u n d e r t a k i n g M a s t e r s d e g r e e s by

c o u r s e work a t A u s t r a l i a n u n i v e r s i t i e s . C o u r s e Awards a r e i n t e n d e d t o

p r o v i d e o p p o r t u n i t i e s f o r f u r t h e r s t u d y t o a p p l i c a n t s who h a v e g a i n e d a

f i r s t d e g r e e , h a v e b e e n i n em p lo y m e n t f o r some y e a r s a n d who w i s h t o

im p ro v e p r o f e s s i o n a l c o m p e te n c e i n t h e i r f i e l d s . A c e n t r a l s e l e c t i o n

c o m m i t t e e a p p o i n t e d by t h e M i n i s t e r a f t e r c o n s i d e r i n g n o m i n a t i o n s from

AEI Awards a r e g r a n t e d t o s t u d e n t s u n d e r t a k i n g M a s t e r s d e g r e e s by c o u r s e

work o r r e s e a r c h a t c o l l e g e s o f a d v a n c e d e d u c a t i o n . T h e i r a im s a r e

s i m i l a r t o t h o s e f o r C o u rse A w a r d s. S e l e c t i o n i s c a r r i e d o u t by a

c e n t r a l s e l e c t i o n c o m m i t t e e w h ic h i s a p p o i n t e d by t h e M i n i s t e r i n c l u d i n g

p e r s o n s n o m i n a t e d by t h e A u s t r a l i a n C o n f e r e n c e o f P r i n c i p a l s o f C o l l e g e s

I n 19 8 1 , t h e D e p a r t m e n t o f E d u c a t i o n r e c e i v e d 1796 r e q u e s t s f o r

r e c o n s i d e r a t i o n . Some 103 d e c i s i o n s were p e n d i n g a t 31 December 1981. Of

t h e 1693 r e c o n s i d e r a t i o n s made d u r i n g t h e y e a r , t h e i n i t i a l d e c i s i o n was

v a r i e d i n 450 c a s e s , o r 2 6 .6 p e r c e n t o f r e c o n s i d e r a t i o n s . The c o m p a r a b l e

f i g u r e o f v a r i e d d e c i s i o n s f o r 1980 was 506 o r 2 5 . 7 p e r c e n t o f c a s e s .
