Effective From February 1

The Restrictive Trade Practices Act 1971, which was

enacted last December, becomes effective on Tuesday, February 1.

The Act is designed to overcome the constitutional

defects found by the High Court to exist' in the old Trade Practices Act.

Though it held the old Act invalid, the High Court made it clear that legislation having much the same effect

would be valid if related to practices engaged in by corporations, and the new Act has been drafted accordingly.

' As I indicated when introducing the legislation '

in the Senate, the new Act is a holding measure, and the Government proposes to introduce a further Bill to strengthen

the legislation at the earliest, opportunity.

■ The obligation to register examinable agreements has been abeyance since the High Court's decision. The new Act . will require agreements entered into since that decision to be registered not later than 2 March. .

Regulations relating to matters such as procedure ■ have been made under the new Act, and copies will be

available from the Government Printer. ·
