HON. R . J . HAWKE MP PRIME MI NI S T ER

WILSON TUCKEY MP MEMBER FOR O' CONNOR AND SHADOW M I N I S T E R FOR HEALTH

1 6 ΤΗ MARCH 1988

I WISH TO MAKE A PERSONAL EXPLANATION.

YESTERDAY.DURING QUESTION TIME IN RESPONSE TO A QUESTION ABOUT

THE PUBLICATION OF DOCTORS DEBTOR RECORDS THE PRIME MINISTER

CALLED ON THE OPPOSITION TO QUOTE ' " ' J O I N WITH US IN CALLING ON

THE A . M . A . TO HAVE THE POLICE INVESTIGATE WHAT APPEARS TO BE A

SERIOUS BREACH OF PATIENT CONFIDENTIALITY".

HE THEN REFERRED TO ME, WHEN HE SAID " I ASK THE HON MEMBER FOR

O'CONNOR TO INFORM US WHETHER, I F THAT POLICE INQUIRY INTO

PATIENT CONFIDENTIALITY DOES' NOT RESULT IN PROSECUTIONS, HE

INTENDS TO TAKE PERSONAL LEGAL ACTION AGAINST THE DOCTORS IN

CHARGE OF THE PRACTICE AND TO PAY FOR I T HIMSELF" .

MADAM SPEAKER, I AM ADVISED THAT THE MEDICAL PRACTICE CONCERNED

HAS NO ARRANGEMENTS TO PROVIDE PAPER OF ANY SORT TO SCHOOLS OR TO

ANY OTHER PROVIDER TO SCHOOLS AND THAT THEY TOO FEEL THEIR

BUSINESS HAS BEEN HARMED BY THE PUBLICATION OF THEIR CONFIDENTIAL

BUSINESS INFORMATION EVEN I F I T I S TWO YEARS OLD.

MADAM SPEAKER, I WOULD THEREFORE WELCOME A POLICE INQUIRY INTO

THIS MATTER AND HAVE CONSEQUENTLY PREPARED A LETTER TO THE

FEDERAL POLICE COMMISSIONER TO BE SIGNED BY MYSELF AND THE PRIME

MINISTER REQUESTING AN IMMEDIATE POLICE INQUIRY TO IDENTIFY THE

PERSON WHO REMOVED THIS INFORMATION FROM THE DOCTORS OFFICE AND

PROVIDED I T TO OTHER PERSONS OR THE SCHOOL.

I TENDER THE LETTER CONTAINING MY SIGNATURE FOR THE PRIME

MINISTERS SIGNATURE.
