Federal Government legislation to outlaw "sham" contractors will not add to housing costs, as claimed again today by the Housing Industry Association.

The Association is scaremongering.

The legislation is modelled on existing legislation in NSW (Section 275-278 Industrial Relations Act 1991), legislation that was carried over by the Greiner Government into the new Act.

Despite numerous requests, the HIA has failed to produce any costings to substantiate its claims.

There is no basis for housing costs to rise.

We are not touching the present arrangements in the industry relating to genuine sub-contractors.

The Australian Industrial Relations Commission will have regard to relevant custom and practice in a dispute over independent contractors. The Commission will also resolve questions about the cost and efficiency of work done by

independent contractors.

The legislation is aimed at "sham" contractors.

These are people who agree or are forced to call themselves a contractor when they are in fact working as an employee for less money and reduced conditions.

The legislation is fair and balanced. It puts disputes in the hands of an impartial, properly qualified tribunal.
