Attached is copy of a letter forwarded today by the Federal Minister for Justice, Senator Michael Tate, to the New South Wales Minister for Police and Emergency Services, Mr Ted Pickering, offering Commonwealth assistance on the implementation

of effective gun control measures.

Dear Minister

Thank you for your letter of 20 August 1991 about firearms

prohibited from importation into Australia.

I am heartened by your advice that the New South Wales Government proposes to ban from sale and re-sale all of the firearms that

are prohibited from importation.

As you may recall from the discussion at Alice Springs with our

Police Minister colleagues, it was agreed that the import prohibition would be defined generically. To attempt to list the prohibited forearms by brand and model in a regulation would require frequent amendments. I attach a copy of the regulation. The relevant definition is marked at page 3.

Since the regulation has been in force (from 21 December 1990), every firearm presented for importation has been checked by the Australian Federal Police Firearms officer at the relevant p o r t . This is in keeping with regular practice and importation is

allowed only after certification that the firearm is an exempt firearm. The AFP u s e s , as its reference material, two world- renowned s o u r c e s , namely "Jane's Infantry Weapons" 14th Ed, "W.H.V. Smith's Small Arms of the Wo r l d " , 12th Ed. I am advised

that there have been no difficulties encountered in this process.

I suggest that you could take a similar approach in your planned regulation to ban sale and re-sale, that is, use a generic

description and enforce the ban by reference to the world authorities cited a b o v e . I am happy to offer the services of the

Australian Federal Police firearms experts to assist the New South Wales authorities.
