Government Acts To Clarify Transition To WorkChoices

Tomorrow a Full Bench of the Australian Industrial Relations Commission (AIRC) will hear an application by the

Minister for Employment and Workplace Relations about the transition to the new WorkChoices system.

The Minister is seeking review of a decision that has significant ramifications for the short term transitional

arrangements regulating the move to collective bargaining under the new WorkChoices system.

After the commencement of WorkChoices any industrial action taken must follow the new rules.

This means that there must be a secret ballot before any protected industrial action. A question has arisen as to

whether this applies in the transitional period.

It is important that this matter be clarified.

The Government has asked a Full Bench of the AIRC to review the original decision.
