Legislation to Commence Establishment of Single National Regulator

The legislative process to establish a single national regulator for offshore petroleum activities in Australia commenced today.

Minister for Resources and Energy, Martin Ferguson AM MP this morning introduced a package of amendment Bills into the House of Representatives that will give effect to the institutional reforms specific to the establishment of the National Offshore Petroleum Safety and Environmental Management Authority (NOPSEMA) and the National Offshore Petroleum Titles Administrator (NOPTA).

“The Government’s legislation will further strengthen safety and improve the regulatory framework of our offshore petroleum industry which plays an important role in maintaining Australia’s energy security,” Minister Ferguson said.

“The Government committed to implementing the lessons of the incidents at Montara and Macondo and today we are acting on that commitment.

“This afternoon I will also table the Government’s final response to the Report of the Montara Commission of Inquiry and the Productivity Commission’s review of the regulatory burden on the upstream petroleum industry.

“Both reports recommend the move to a single national regulator as a means of increasing safety, both for workers and the environment, as indeed did the report of the US Commission of Inquiry into Deepwater Horizon for their jurisdiction.

“It will streamline processes and reduce unnecessary red tape while at the same time putting in place mechanisms to improve oversight and monitoring to improve compliance with strengthened regulatory requirements.”

Under the new framework NOPTA will take over the administration of titles while preserving the role of each state and the Northern Territory in decision making on key petroleum projects in Commonwealth waters that could impact the individual state or territory.

NOPSEMA will assume the functions currently carried out by the existing National Offshore Petroleum Safety Authority’s (NOPSA) and its functions will be increased to oversee operations from exploration through to decommissioning.

Minister Ferguson has requested that the package of Bills now be referred to the House Standing Committee on Agriculture, Resources, Fisheries and Forestry and hopes their passage through the Parliament will be completed in the spring sitting.
