SENATOR THE HON NICK BOLKUS SHADOW ATTORNEY GENERAL SHADOW MINISTER FOR JUSTICE LABOR SENATOR FOR SOUTH AUSTRALIA

MEDIA RELEASE

No.48/97 23 September 1997

NOA NADRUKU

"People who knowingly drink to excess should take full responsibility for their actions," Shadow Attorney-General and Minister for Justice, Senator Nick Bolkus said today.

"The Labor Party supports changing the law to prevent people from relying on the defence of intoxication where the person concerned has decided to become intoxicated."

"People should know that when they make the decision to get drunk or to take drugs that they have to live with the consequences of any actions they take whilst under the influence."

"The Model Criminal Code, an initiative of the previous Labor Government, does not allow intoxication to be relied upon in circumstances such as occurred with Mr Nadruku."

"But ultimately, it is up to individual States and Territories to change the law."

"The law in the ACT, and those other juridictions, that still allow the defence of intoxication to be used in this way should be changed," Senator Bolkus said.

"Any State or Territory government that sought to change this law would have the full support of the Labor Party."
