SUPPLEMENTARY EXPLANATORY MEMORANDUM
Amendments and New Clauses to be moved on behalf of the Government

HIGHER EDUCATION FUNDING AMENDMENT BILL 1999 - AMENDMENTS AND NEW CLAUSES
OUTLINE
The Higher Education Funding Amendment Bill 1999 varies the aggregate funding levels for 1999 and 2000 and inserts the aggregate funding levels for 2001 in Part 2A of the Higher Education Funding Act 1988 (HEFA). In doing so the Bill implements a number measures announced by the Government in the 1999-00 Budget.
The Government has decided to move amendments to the Bill to:
· increase the proposed aggregate funding level under section 23C of HEFA to ensure that holders of Australian Postgraduate Awards and Australian Postgraduate Awards (Industry) are not disadvantaged by the impact of tax reform on prices; and
· add a new clause to correct a citation of the Medicare Levy Act 1986 in sub section 106Q(7) of HEFA, inserted by Senate amendment during passage of the Higher Education Legislation Amendment Act 1996 (No. 74 of 1996).
FINANCIAL IMPACT
The financial impact of these amendments is to increase the level of funding provided under subsection 23C(2) of HEFA by $1,977,000 in 2000 and by $2,472,000 in 2001.

NOTES ON AMENDMENTS AND NEW CLAUSES
Clause 1
Provides for the new item 8 of Schedule 1 to the Bill (inserted by clause 5 of these amendments) to come into effect immediately after the commencement of subsection 106Q(7) of HEFA (inserted by item 31 of Schedule 1 to the Higher Education Legislation Amendment Act 1996 ). Subsection 106Q(7) of HEFA commenced on 12 December 1996.
Clause 2
Makes a technical amendment to clause 3 of the Bill to reflect amendments made by clause 1 of these amendments.
Clauses 3 and 4
Amend item 4 of Schedule 1 to the Bill to provide additional funds in the funding years 2000 and 2001 for Australian Postgraduate Awards and Australian Postgraduate Awards (Industry) to ensure that Award holders are not disadvantaged by the impact of tax reform on prices .
Clause 5
Adds a new item 8 to Schedule 1 of the Bill to amend subsection 106Q(7) of HEFA to correctly cite the Medicare Levy Act 1986 .
