AMENDMENTS TO THE AUSTRALIAN INSTITUTE OF HEALTH AND WELFARE AMENDMENT BILL 2018

 

OUTLINE

 

The proposed government amendment will change the proposed commencement date of the Australian Institute of Health and Welfare Amendment Bill 2018 (the Bill) from

1 July 2018 to a date fixed by Proclamation. If the provisions do not commence within the period of six months beginning on the day the Act receives Royal Assent, the Act would commence the day after the end of that period.

 

Financial Impact Statement

 

There is no financial impact from the proposed amendment.

 

Statement of Compatibility with Human Rights

 

The Bill is compatible with the human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011 .

 

Personal information is collected by the Australian Institute of Health and Welfare (the Institute) for statistical purposes to support the development of an evidence base across the health, welfare and housing sectors. This is part of the Institute’s core functions and includes the collection of health-related information and statistics and welfare-related information and statistics.

 

There are appropriate safeguards in place to support these activities including strict legislative obligations and confidentiality provisions. These measures ensure that there is no arbitrary or unlawful interference with an individual’s privacy, which is consistent with Article 17 of the International Covenant on Civil and Political Rights.

 

NOTES ON CLAUSES

 

Clause 2 - Commencement

 

This clause will amend the commencement date for the Bill from 1 July 2018 to a single date to be fixed by Proclamation. If no proclamation is made, the provisions will commence six months after the Act receives Royal Assent.

 

The intent of this change is to remove 1 July 2018 as the start date for the Bill and provide for commencement within a reasonable timeframe.
