SUPPLEMENTARY Explanatory Memorandum
Amendments to be Moved on Behalf of the Government
GENERAL OUTLINE
These amendments to the Clean Energy Regulator Bill 2011 relate to the disclosure of information by the Regulator to the Energy Security Council.
FINANCIAL IMPACT STATEMENT
These amendments will have no financial impact additional to that outlined in the Explanatory Memorandum to the Clean Energy Bill 2011.
REGULATION IMPACT STATMENT
These amendments have no major impacts beyond those outlined in the Regulation Impact Statement of the Clean Energy Bill 2011. No additional Regulation Impact Statement is required.
ITEM 1 DISCLOSURE TO CERTAIN AGENCIES, BODIES AND PERSONS
This item adds the Energy Security Council to the list of agencies, bodies and persons to which disclosure of protected information is allowed under clause 49 of the Bill.
The Energy Security Council will be established to advise the Government in the event that systemic risks to energy security emerge from the financial impairment of power stations from any source, including from the introduction of the carbon pricing mechanism. The amendment provides certainty that the Council may receive protected information from the Clean Energy Regulator in the same way as other agencies, bodies and persons listed in clause 49, in order to assist the Council to perform its functions.
