SUPPLEMENTARY explanatory memorandum
Amendments to be Moved on Behalf of the Government
Item 1 excluded projects
Item 1 makes a minor amendment to clause 56(2) to add to the list of matters the Minister must have regard to when making a decision whether to recommend to the Governor-General that regulations be made to exclude certain types of sequestration or emissions avoidance projects that would otherwise be eligible under the scheme.
Clause 56(2) requires the Minister to consider whether there is a significant risk that a particular kind of project would have a significant adverse impact on the availability of water, the conservation of biodiversity, employment, or the local community in, or in the vicinity of, the project area, or any of the project areas, for that kind of project.
The amendment would require the Minister to also consider whether there is a significant risk that a particular kind of project would have a significant adverse impact on land access for agricultural production in, or in the vicinity of, the project area, or any of the project areas, for that kind of project.
