Agricultural and Veterinary Chemicals Legislation Amendment (Name Change) Bill 2004

General Outline

The Agricultural and Veterinary Chemicals Legislation Amendment (Name Change) Bill 2004 has as its aims:

1.1.   the amendment of the name of the National Registration Authority for Agricultural and Veterinary Chemicals (NRA) to the Australian Pesticides and Veterinary Medicines Authority (APVMA), and

1.2.   the introduction of measures to protect the APVMA’s logo from inappropriate use.

The Name Change Act amends a suite of legislation to give effect to the proposed name change. Each of the following Acts refer to the NRA:

Agricultural and Veterinary Chemicals Code Act 1994

Agricultural and Veterinary Chemicals Act 1994

Agricultural and Veterinary Chemical Products (Collection of Interim Levy) Act 1994

Agricultural and Veterinary Chemical Products (Collection of Levy) Act 1994

The NRA is the authority responsible for the national system of approvals and registrations underpinning the national agricultural and veterinary chemicals regime. For some extended period, the Board of the NRA has expressed views that the title of the organisation does not adequately reflect its purpose, nor is it consistent with international nomenclature practised by other international chemical regulators and within the OECD, which sets the international standards and benchmarks for chemicals management.  In addition, a survey in 1998/99 demonstrated that the name of the organisation was not well known beyond chemical manufacturers and was often confused with the National Rifleman’s’ Association in the USA.

The NRA Board promotes awareness of its role through a national and international communications program. The Board acknowledges that it is an important ingredient of the public awareness of the role of the NRA to change its name to one that readily indicates its role and area of focus. Where the name, or the initials, of the NRA appear in other Commonwealth legislation, it is intended to rely on the provisions of the Acts Interpretation Act 1901 , to update references to the APVMA rather than undertake specific and exhaustive legislative changes and burden other Departments with the task of changing their legislation as a result of the technical changes in the Department of Agriculture, Fisheries and Forestry legislation.

Financial Impact Statement

The amendments in this Bill are not expected to have any financial impact on the Commonwealth budget.

The NRA has provided for the amendments to its letterhead, publications, website and printed material generally. Printed labels will be phased out over time and as the products come before the NRA for reconsideration or amendment.  Industry were not obliged to carryout a label change to accommodate the new symbol and name.

A Bill for an Act to amend legislation relating to agricultural and veterinary chemicals and for related purposes.

Notes on Clauses

Short Title

The short title of this Act is the Agricultural and Veterinary Chemicals Legislation Amendment (Name Change) Act 2004.

Commencement

This section states that each provision of this Act specified in column 1 of the table commences or is taken to have commenced, in accordance with column 2 of the table.  Any other statement in column 2 has effect according to its terms.

Schedule 1 commencement

The commencement of certain sections of this Act may be affected by certain provisions in other proposed legislation.

Sections 1 to 3 and anything in this Act not covered elsewhere by the commencement table, commence on the day this Act receives Royal Assent.

The following items covered by Item 2 of the commencement table will commence on a day to be fixed by Proclamation, or if any of the these provisions do not commence within the period of 6 months beginning on the day on which this Act received the Royal Assent, the items commence on the first day after the end of the period:

Schedule 2 commencement

Schedule 2 commences the day after this Act receives Royal Assent.

Schedule 1 - Name change for National Registration Authority for Agricultural and Veterinary Chemicals

1.             The Agricultural and Veterinary Chemicals Legislation Amendment (Name Change) Bill 2004 (the Name Change Act) amends a suite of legislation to change the name of the National Registration Authority for Agricultural and Veterinary Chemicals (NRA) to the Australian Pesticides and Veterinary Medicines Authority (APVMA). Where appropriate, the initials “NRA” are omitted and substituted with the “APVMA”.

2.             The following legislation in Schedule 1 is changed by the Name Change Act:

Agricultural and Veterinary Chemicals Code Act 1994    

Agricultural and Veterinary Chemical Products (Collection of Interim Levy) Act 1994

3.             In July 1991, the Commonwealth, State and Territory Ministers responsible for agricultural issues decided to establish a National Registration Scheme for Agricultural and Veterinary Chemicals. Under the agreed arrangements, the Commonwealth would be responsible for the registration and control of agriculture and veterinary chemicals (Agvet chemicals) up to the point of retail sale. The States and Territories maintain responsibility for control of use of the Agvet chemicals. 

 

4.             The NRA was established on 15 June 1993, pursuant to section 6 of the Agricultural and Veterinary Chemicals (Administration) Act 1992 (Agvet Admin Act), to undertake the Commonwealth’s regulatory responsibilities under the National Registration Scheme. By virtue of section 4 of the Agvet Admin Act, the term NRA means the National Registration Authority for Agricultural and Veterinary Chemicals established under section 6 above.

 

5.             The intent of this Name Change Act, is to ensure that the general public and not just industry and manufacturers are aware of the purpose of the NRA, and that its name is not inconsistent with international nomenclature practised by other international chemical regulators and within the OECD.

 

6.             To achieve this intention each reference to the name NRA or its initials is amended in the legislation listed above.

Agricultural and Veterinary Chemicals Act 1994

Clause 1 - Section 4: insert definition

7.             This clause inserts the definition of APVMA to mean the Australian Pesticides and Veterinary Medicines Authority. The name, APVMA, is continued in existence by operation of section 4 of the Agvet Admin Act. It is not intended that the NRA be disbanded by the introduction of this name change, merely, it reflects a continuity of the Authority under a new name.

Clause 2 - Section 4 (definition of NRA)

8.             The definition of NRA is repealed as it is no longer required now that the definition of APVMA has been inserted (clause 1 section 4 above).

Change of “NRA” to “ APVMA” - various clauses

9.             In line with the intent of this Name Change Act, each reference to the NRA by name or initials , wherever occurring, is omitted and substituted with either the Australian Pesticides and Veterinary Medicines Authority or the APVMA as appropriate. Each occurrence of the term “NRA” is identified in this Name Change Act. It is not intended to address each individual amendment but rather, by use of a Schedule to this Explanatory Memorandum, to list each amendment as it appears and applies to the relevant Act being amended.

10.          Throughout this Name Change Act, reference is made to amendments of headings of various sections to properly reflect the name change from the “NRA” to the “APVMA”. Each such heading amendment is listed in the Schedule attached to this Explanatory Memorandum. It is not intended to address each heading alteration individually.

Agricultural and Veterinary Chemicals (Administration) Act 1992

Clause 7: Title

11.          The title of the Agricultural and Veterinary Chemicals (Administration) Act 1992 is repealed and substitued with the new title: An Act to establish an authoriy for the registraiton of agricultural and veterinary chemicals and for related purposes .

Clause 8: Section 3

12.          In line with the intent of this Name Change Act, reference to “National Registration Authority” is omitted and substituted with ‘national registration authority’. This demonstrates that, whilst the authority retains its national operation, it is no longer to be known by the name National Registration Authority.

Clause 9: Section 4 insert

13.          This clause inserts the definition of APVMA to mean the Australian Pesticides and Veterinary Medicines Authority. The name APVMA is continued in existence by operation of section 6 of the Agvet Admin Act.

Clause 14: Section 4 (definition of NRA)

14.          The definition of NRA is repealed as it is no longer required under these legislative changes. The definition of the APVMA has been inserted (clause 9 Section 4 above).

Clause 15: Part 2 (heading)

15.          Part 2 of the Agvet Admin Act provides for the set up and operation of the NRA. The heading to Part 2 is repealed and substituted with the following heading: Part 2- Establishment, functions and powers of APVMA. This amendment will ensure that reference is properly made to the APVMA and not the NRA as appropriate.

16.          In line with the intent of this Name Change Act, the powers of the NRA are not changed, (save as provided for in this Name Change Act), but continue to operate under the new name, APVMA.

Clause 16: Section 6

17.          This section is repealed and substituted with a new section 6. The NRA was established on 15 June 1993 pursuant to the original section 6 to undertake the Commonwealth’s regulatory responsibilities under the National Registration Scheme.

18.          This new section provides for the continuity of the Authority known immediately before the commencement of this provision as the NRA, with the new name, the APVMA, as provided for in this Name Change Act. As intended, only the name of the authority is changed, its powers and functions remain as originally granted or amended, (save as provided for in this Name Change Act) (Schedule 2 - Protection of APVMA’s logo).

Clause 33: Part 3 (heading)

19.          Part 3 of the Agvet Admin Act includes provisions for the constitution and meeting of the NRA. This clause amends the name of the heading of this Part to: Part 3 - Constitution and meetings of APVMA. This amendment will ensure that reference is properly made to the APVMA and not the NRA as appropriate.

Clause 132: Section 3 insert

20.          This clause inserts the definition of APVMA to mean the Australian Pesticides and Veterinary Medicines Authority. The name, APVMA, is continued in existence by operation of section 6 of the Agvet Admin Act.

Clause 133: Section 3 (definition of NRA)

21.          The definition of NRA is repealed as it is no longer required under these legislative changes. The definition of the APVMA has been inserted (clause 132 - Section 3 above).

Clause 139: Section 3 of the Schedule

22.          This clause inserts the definition of APVMA to mean the Australian Pesticides and Veterinary Medicines Authority. The name, APVMA, is continued in existence by operation of section 6 of the Agvet Admin Act.

Clause 225: Division 7 of Part 2 of the Schedule (heading)

23.          The NRA publishes notices advising of approvals of active constituents, registrations of chemical products, variation, suspension or cancellation of approvals or registrations, or advising of the end of the registration of a chemical product. Such notices are published under Division 7 of Part 2 of the Schedule.

24.          The heading to this Division is amended to Division 7 - Publication of notices by APVMA to refer to the APVMA. This amendment ensures that reference is properly made to the APVMA and not the NRA as appropriate in the issue of such notices.

Clause 290: Division 9 of Part 2A of the Schedule (heading)

25.          This Division provides for the NRA to publish notices and certain other instruments in respect of listed registration of a chemical product. The heading is amended to: Division 9 - Publication of notices and certain other instruments by APVMA .

26.          This amendment ensures that reference is properly made to the APVMA and not the NRA as appropriate in the publication of notice and instruments.

Clause 447: Section 3 insert

27.          This clause inserts the definition of APVMA to mean the Australian Pesticides and Veterinary Medicines Authority. The name, APVMA, is continued in existence by operation of section 6 of the Agvet Admin Act.

Clause 460: subsection 16(1)

28.          In the context of the failure of other provisions upon the commencement of the Financial Framework Legislation Amendment Act 2004 , this clause changes the name of the NRA to the APVMA in subsection 16(1). This clause does not have effect if the Financial Framework Legislation Amendment Act 2004 commences before or at the same time as this Act, and clauses 461 and 462 have effect.

29.          In the context of the commencement of item 94 of Schedule 1 of the Financial Framework Legislation Amendment Act 2004, and upon the occurrence of the provisions of item 2 of the commencement table of this Act, this clause ensures that the amendments introduced in subsection 16(1) by item 94 of the Financial Framework Legislation Amendment Act 2004 reflects the change of the name to the APVMA.

Clause 462: subsection 16(2)

30.          In the context of the failure of other provisions upon the commencement of the Financial Framework Legislation Amendment Act 2004 , this clause changes the name of the NRA to the APVMA in subsection 16(2). This clause does not have effect if the Financial Framework Legislation Amendment Act 2004 commences before or at the same time as this Act, and clauses 461 and 462 have effect.

Clause 463: subsection 16(2)

31.          In the context of the commencement of item 94 of Schedule 1 of the Financial Framework Legislation Amendment Act 2004, and upon the occurrence of the provisions of item 2 of the commencement table of this Act, this clause ensures that the amendments introduced in subsection 16(2) by item 94 of the Financial Framework Legislation Amendment Act 2004 reflects the change of the name to the APVMA.

Clause 470: Section 3 insert

32.          This clause inserts the definition of APVMA to mean the Australian Pesticides and Veterinary Medicines Authority. The name, APVMA, is continued in existence by operation of section 6 of the Agvet Admin Act.

Clause 473: Section 3 (definition of NRA)

33.          The definition of NRA is repealed as it is no longer required under these legislative changes. The definition of the APVMA has been inserted (clause 468 Section 3 above).

Clause 483: subsection 19(1)

34.          In the context of the failure of other provisions upon the commencement of the Financial Framework Legislation Amendment Act 2004 , this clause changes the name of the NRA to the APVMA in subsection 19(1). This clause does not have effect if the Financial Framework Legislation Amendment Act 2004 commences before or at the same time as this Act, and clauses 484 and 485 have effect.

35.          In the context of the commencement of item 95 of Schedule 1 of the Financial Framework Legislation Amendment Act 2004, and upon the occurrence of the provisions of item 2 of the commencement table of this Act, this clause ensures that the amendments introduced in subsection 19(1) by item 95 of the Financial Framework Legislation Amendment Act 2004 reflects the change of the name to the APVMA.

Clause 485: subsection 19(2)

36.          In the context of the failure of other provisions upon the commencement of the Financial Framework Legislation Amendment Act 2004 , this clause changes the name of the NRA to the APVMA in subsection 19(2). This clause does not have effect if the Financial Framework Legislation Amendment Act 2004 commences before or at the same time as this Act, and clauses 485 and 486 have effect.

37.          In the context of the commencement of item 95 of Schedule 1 of the Financial Framework Legislation Amendment Act 2004, and upon the occurrence of the provisions of item 2 of the commencement table of this Act, this clause ensures that the amendments introduced in subsection 19(2) by item 95 of the Financial Framework Legislation Amendment Act 2004 reflects the change of the name to the APVMA.



Schedule 2 - protection of the APVMA’s logo

Agricultural and Veterinary Chemicals Code Act 199 4

38.          In preparation for its name change, the NRA had created a new logo symbol for its official papers, letterhead, website and published material generally. All documents which emanate from the APVMA will bear the new logo and colour scheme with its distinctive diamond shape and tick ‘ v ‘ mark.

39.          The NRA is responsible for the registration and control of agriculture and veterinary chemicals up to the point of retail sale. In undertaking this responsibility, the NRA approves active constituents for existing or proposed chemical products, registers chemical products and approves labels for chemical products. In doing this, the NRA will correspond with applicants and interested persons, assessing agencies and other relevant bodies. Approval of an active constituent takes place by the NRA entering in the Record of Approved Active Constituents relevant details which include the distinguishing number, instructions for use etc. Registration of a chemical product takes place by the NRA entering in the Register or Chemical Products relevant details including the distinguishing number. Similarly, when a label is approved the NRA gives it a distinguishing number and determines its size, type and particulars that will appear on the label.

40.          At any time during this process, a person may attempt to carry out a fraud on the system and allege that its product and label are approved by the NRA. Attempts may be made to use the name and symbol of the APVMA to achieve a market share or promotion of goods generally. Additionally, a person may attempt to use the APVMA name or symbol as part of its firms name, business name or on any carriage or vessel, or attached to goods manufactured or sold.

Clause 1: at the end of Part 10 of the Schedule

41.          This clause inserts new section 170A to provide protection to the protected name or symbol of the APVMA.  This section provides that a  person must not use the protected name or symbol of the APVMA unless permitted by the APVMA.

42.          A person must not use for his business, trade or occupation, the name ‘APVMA’ or any part of it, or the symbol of the APVMA, as part of his business logo, premises or apply it as a trade mark to goods manufactured, produced, sold, offered for sale or let or hire. It is intended that the use of the name and logo symbol be exclusive to the APVMA (subsection 170A(1)).

43.          A penalty of 30 penalty units ($3,300) applies to the offence in Section 170A.

44.          The APVMA may consent in writing to the use or application of the name or symbol of the APVMA (subsection 170A(2)).  The defendant bears an evidential burden in relation to consented use of the name or symbol.

45.          Any rights conferred by law on any other person in relation to a trade mark the is registered under the Trade Marks Act 1995 or a design registered under the Designs Act [2003] that was registered immediately before the commencement of the protection of this protection in relation to the symbol or name (subsection 170A(3)).

46.          Similarly, section 170A does not affect  the use or any rights conferred by law relating to the use of the name or symbol by a person using the name or symbol immediately before the commencement of the protection, if that person was using the name or symbol in good faith (subsection 170A(4)).

47.          The NRA researched the logo and name before adopting both as the name by which it is to be known and the symbol which it will use as its logo. Neither the name nor the symbol were protected by other legislation as noted above.

48.          For the purposes of this protection, protected name means ‘APVMA’ or ‘Australian Pesticides and Veterinary Medicines Authority’. The protected symbol means the logo of the APVMA which is set out in the regulations (subsection 170A(5)).

49.          Clause 2: reference to Designs Act 2003

50.          Section 170A of this Act, being item 1 of this Schedule, may commence before section 3 to 161 of the Designs Act 2003. Should this occur, then the reference in paragraph (3)(b) of section 170A above, of a State or participating Territory is to be taken to be a reference to the Designs Act 1906 until such time as sections 3 to 161, above, commence.
