Title of Bill

Extension of Sunset of Parliamentary Joint Committee on Native Title Bill 2004

A Bill for an Act to extend for 2 two years the operation of the Parliamentary Joint Committee on Native Title and the Aboriginal and Torres Strait Islander Land Fund

Outline

The purpose of the Bill is to extend s the operation of the Parliamentary Joint Committee on Native Title and the Aboriginal and Torres Strait Islander Land Fund (the PJC) to 23 March 2006 for a further two years .

 

The Committee was first established in 1994 with a five year sunset by the Native Title Act 1993 .  The sunset was extended a further five years through the 1998 amendments to the Native Title Act.  Both the original and extended sunsets were intended to provide an opportunity for the Committee to review the Act following its enactment and the substantial changes made in 1998.

The Bill extends the sunset of the Committee to enable it to complete the inquiries set out in paragraph 206(d) of the Native Title Act.

Notes on clauses

Clause 1 - Short title

1.      Clause 1 is a formal provision specifying the short title of the Bill.

Clause 2 - Commencement

2.      Clause 2 provides that T t he Bill will commence s on the day it receives Royal Assent.

Clause 3 - Schedules

3.      Clause 3 provides that the Act specified in the Schedule is amended as set out in the applicable item in the Schedule.

Schedule 1

ITEM 1

Item 1 of Schedule 1 amends section 207 of the Native Title Act 1993 by omitting “2004” and substituting 2006”.

Section 207 of the Native Title Act currently provides that Part 12 of the Act ceases to be in force on 23 March 2004.  The PJC is established by Part 12 of the Act.  The amendment extends the operation of the PJC until , which provides that the Committee sunsets on 23 March 2004, to extend the sunset to 23 March 2006.
