Amendment 1
1. Proposed subsection 22(1A) as introduced is replaced by a new proposed subsection 22(1A). The new subsection ensures that the Sex Discrimination Act will not prevent States and Territories legislating to limit access to ART services to married couples (or married couples who are not living separately and apart from their spouse) and de facto couples. The provision will not, however, permit States and Territories to discriminate between married and de facto couples.
Amendment 2
2. This amendment is consequential upon amendment 1 and also corrects a minor drafting error by inserting “refusal or”.
