Purpose

To amend a reference in the NRS Levy Imposition Act 1998 to the Telecommunications Act 1997 to the Telecommunications (Consumer Protection and Service Standards) Act 1998 .

Background

The National Relay Service (NRS) is the service which provides persons who are deaf or who have impaired hearing with access to a standard telephone service on terms comparable to those on which oth er Australians have access to a standard telephone service.  The NRS is legislated in Part 7A of the Telecommunications Act 1998 .

The NRS is funded by the imposition of a levy on telecommunications carriers.  The levy is imposed in proportion to the carrier’s share of the total telecommunications carrier revenue.

Part 7A is to be repealed upon the enactment of the Telecommunications Legislation Amendment Bill 1998 and the provisions will be reenacted in the Telecommunications (Consumer Protection and Service Standards) Bill 1998.

Main Provisions

Item 1 amends the reference in the NRS Levy Imposition Act 1998 to reflect that the NRS provisions will be contained in the Telecommunications (Consumer Protection and Service Standards) Act 1998

Item 2 makes it clear that the NRS Levy Imposition Act 1998 continues to apply in relation to levy for a quarter that ended on or before 30 June 1998 as if the amendment in item 1 had not been made and the repeal of Part 7A had not occurred.
