Part 1 Commonwealth contribution amounts

Higher Education Support Act 2003

1  Section 33-10

Repeal the section, substitute:

33-10   Commonwealth contribution amounts

                   The Commonwealth contribution amount , for a place in a * funding cluster, is:

                     (a)  for 2015—the amount specified in the table; and

                     (b)  for a later year—the amount specified in the table as indexed and replaced on 1 January in each such year in accordance with Division 198.

2  Application

The amendments made by this Part apply in relation to Commonwealth contribution amounts for:

                     (a)  the calendar year in which this Act receives the Royal Assent; and

                     (b)  later calendar years.

3  Indexation of Commonwealth contribution amounts

(1)       This item applies if this Schedule commences after 1 January 2016.

(2)       On 1 January 2016 and each subsequent 1 January (if any) that occurs before this Schedule commences, the Commonwealth contribution amount for the purposes of the Higher Education Support Act 2003 is taken to have been indexed under Part 5-6 of that Act, as if the amendments made by this Schedule had been in effect on that 1 January. The indexed amount is taken to be the Commonwealth contribution amount on and from that 1 January.

4  Paragraph 1.5.1

Repeal the paragraph, substitute:

1.5.1        In these Guidelines, unless the contrary intention appears:

 

ASGC Remoteness Structure             means the Australian Standard Geographical Classification (ASGC) Remoteness Structure published by the Australian Bureau of Statistics (ABS)

 

ASGS Remoteness Structure             means the Australian Statistical Geography Standard (ASGS) Remoteness Structure published by the ABS which replaces the ASGC Remoteness Structure from December 2012

 

campus                                              means the physical location at which a provider delivers a unit of study. For on-line/distance education courses or where studies require attendance at locations such as a health centre, teaching hospital or agricultural farm, the campus is the location from which the course is administered

 

Department                                       means in accordance with the Administrative Arrangement Order, the Department responsible for administering Parts 2-2 and 3-2 of the Act, or part thereof

 

external                                            means a mode of attendance for a unit of study for which the provider delivers the course materials to the student and the student is not required to attend classes on campus on a regular basis

 

headquarters                                    is a provider’s campus location which has the largest internal and multi-modal EFTSL of Commonwealth supported students

 

HEIMS                                             means the Higher Education Information Management System

 

HESC                                                means the Higher Education Student Collection which is a component of the Higher Education Statistics Collection required under subsection 19-70(1) of the Act

 

internal                                              means a mode of attendance for a unit of study for which the student must attend classes at the provider’s facilities on a regular basis

 

Minister                                            means, in accordance with the Administrative Arrangement Order, the Minister responsible for administering Part 2-2 and 3-2 of the Act, or part thereof, or the Secretary or APS employee of the Department when acting under a delegation made pursuant to sections 238-1 and 238-5 of the Act

 

multi-modal                                     means a mode of attendance for a unit of study that is undertaken partially in an internal mode of attendance and partially in an external mode

 

provider                                            meansHigher Education Provider

5  Clause 4.10 (heading)

Repeal the heading, substitute:

4.10     AMOUNT OF REGIONAL LOADING

6  Paragraph 4.10.5

Repeal the paragraph, substitute:

4.10.5        The total amount of regional loading available in each year is fixed. The amount available is, or is taken to have been:

                     (a)  for 2015—$66,859,747; or

                     (b)  for a later year—the amount for the previous year indexed in accordance with the method set out in Part 5-6 of the Act .

7  Paragraph 4.15.1

Repeal the paragraph, substitute:

4.15.1    A provider is eligible for regional loading if it is a Table A or Table B provider under section 16-15 or 16-20 of the Act respectively.

8  Paragraph 5.10.1

Repeal the paragraph, substitute:

5.10.1        The amount of medical student loading (A) payable to a provider for a year will be calculated in accordance with the following formula:

      A = B times C

      where:

      B is the student load determined in accordance with paragraph 5.10.5.

      C is the amount of medical student loading per Commonwealth supported place for the relevant year in a medical course of study.

 

5.10.2         The total amount of medical student loading per Commonwealth supported place is, or is taken to have been:

                     (a)  for 2015—$1,309; or

                     (b)  for a later year—the amount for the previous year indexed in accordance with the method set out in Part 5-6 of the Act .

9  Paragraph 6.5.1

Repeal the paragraph, substitute:

6.5.1           The amount of enabling loading (A) payable to a provider for a year will be calculated in accordance with the following formula:

      A = B times C

where:

B   is the number of Commonwealth supported places in enabling courses of study allocated to the provider for the grant year in the provider’s Commonwealth Grant Scheme funding agreement for that year.

C   is the amount of enabling loading per Commonwealth supported place for the relevant year.

 

6.5.2           The total amount of enabling loading per Commonwealth supported place is, or is taken to have been:

                     (a)  for 2015—$3,021; or

                     (b)  for a later year—the amount for the previous year indexed in accordance with the method set out in Part 5-6 of the Act .

10  Application

The amendments made by this Part apply in relation to regional loadings, medical student loadings and enabling loadings for:

                     (a)  the calendar year in which this Act receives the Royal Assent; and

                     (b)  later calendar years.
