Australian Capital Territory (Self-Government) Amendment (Disallowance and Amendment Power of the Commonwealth) Bill 2010

 

 

(Amendments to be moved by the Leader of the Australian Greens, Senator Bob Brown, in committee of the whole)

(1)     Title, page 1 (lines 3 and 4), omit “ any Act of the Legislative Assembly of the Australian Capital Territory ”, substitute “ any enactment of a self-governing territory ”.

(2)     Clause 1, page 1 (line 8), omit “ Australian Capital Territory ”, substitute “ Territories Legislation ”.

(3)     Clause 4, page 2 (lines 9 to 18), omit the clause, substitute:

4   Objects of Act

                   The objects of this Act are:

                     (a)  to remove the Governor-General’s power under the Australian Capital Territory (Self-Government) Act 1988 to disallow or amend any enactment of the Legislative Assembly for the Australian Capital Territory and ensure that the Legislative Assembly for the Australian Capital Territory has exclusive legislative authority and responsibility for making laws for the Australian Capital Territory; and

                     (b)  to remove the Governor-General’s power under the Northern Territory (Self-Government) Act 1978 to disallow or amend any enactment of the Legislative Assembly of the Northern Territory and ensure that the Legislative Assembly of the Northern Territory has exclusive legislative authority and responsibility for making laws for the Northern Territory; and

                     (c)  to remove the Governor-General’s power under the Norfolk Island Act 1979 to disallow or amend any enactment of the Legislative Assembly of Norfolk Island and ensure that the Legislative Assembly of Norfolk Island has exclusive legislative authority and responsibility for making laws for Norfolk Island.

(4)     Page 4 (after line 5), at the end of the bill, add:

Schedule 2 — Amendment of the Northern Territory (Self-Government) Act 1978

1  Section 9

Repeal the section.

Schedule 3 — Amendment of the Norfolk Island Act 1979

1  Section 23

Repeal the section.
