Customs Legislation Amendment (Modernising Import Controls and Other Measures) Bill 2006
(Amendments to be moved by Senator Ludwig on behalf of the Opposition in committee of the whole)
(1) Schedule 1, item 36, page 16 (after line 30), at the end of section 243ZH, add:
(5) An infringement notice for an offence covered by section 243ZF does not have any effect unless the goods to which the offence relates:
(a) were seized in a section 234AA place; or
(b) were seized in a section 243ABA area; or
(c) were imported by post; or
(d) are the unaccompanied personal or household effects of a passenger in, or a member of the crew of, a ship or aircraft.

(2) Schedule 1, item 36, page 17 (line 18), omit “in any other case”, substitute “if the notice relates to goods which were imported by post or which are the unaccompanied personal or household effects of a passenger in, or a member of the crew of, a ship or aircraft”.
