threshold concentration , for a testable drug, means:

                     (a)  if the testable drug is alcohol—0.08% blood alcohol concentration; or

                     (b)  for any other testable drug—the concentration of the testable drug prescribed by the rules as the minimum concentration required to be present in a sample subjected to a drug test for the drug test to be a positive drug test.

                   (ab)  prescribing the concentrations of testable drugs for the purposes of the definition of threshold concentration in subsection 23(1);

( 7 )     Schedule  12 , item  3 , page 176 (after line 8) , at the end of section  38FA , add:

             (2)  For the purposes of paragraph (1)(ab), the Minister must not prescribe a concentration of a testable drug as the threshold concentration for that drug unless that concentration would be reasonably likely to cause:

                     (a)  a degree of impairment to the person affected by the drug that would be noticeable to another person; or

                     (b)  a degree of impairment to the person affected by the drug that would be sufficient to hinder the person in his or her employment.

                     (a)  the drug test was requested by the person; and

                     (b)  the person requested the drug test to test the accuracy of an earlier positive drug test.

 ( 11 )  Schedule  12 , item  16 , page 183 (after line 10) , after subsection  63(4A) , insert:

       (4AA)  The Secretary must not notify a person to do an act described in paragraph (4)(c) if:

                     (a)  the Secretary has previously notified the person to do that act; and

                     (b)  the notification would require the person to do that act more than once in a 6 month period; and

                     (c)  the previous drug test conducted on a sample provided by the person was not a positive drug test.

          (4C)  The Secretary must not notify a person under subsection (4) that he or she is required to do an act or thing described in paragraph (4)(b) if:

                     (a)  the person is a drug test trial pool member; and

                     (b)  the person has been required to do an act or thing described in paragraph (4)(c).
