Carbon Pollution Reduction Scheme (Consequential Amendments) Bill 2009 [No. 2]

 

 

(1)     Schedule 1, page 66 (after line 5), after item 195, insert:

195A  Section 7

Insert:

carbon dioxide equivalence of an amount of HFC has the same meaning as in the National Greenhouse and Energy Reporting Act 2007 .

195B  Section 7

Insert:

national HFC quota means the total of HFCs that may be imported into or manufactured in Australia as prescribed by the regulations.

Repeal the subsection, substitute:

             (3)  An SGG licence:

                     (a)  must state that it relates to SGGs;

                     (b)  must specify the activities it allows; and

                     (c)  if a national HFC quota is prescribed for a licence period—must express the maximum quantity of HFCs, expressed in carbon dioxide equivalence tonnes, permitted for importation, manufacture or other use by the licensee in any such activities.

Insert:

71  HFC quota

                   Without limiting section 70, the Governor General may make regulations prescribing:

                     (a)  the national HFC quota expressed in carbon dioxide equivalence tonnes that may be imported into or manufactured in Australia during any licence period referred to in subsection 8AA(2); and

                     (b)  the method by which applications for and allocations of maximum quantities of HFCs are made for licences granted in accordance with subsection 16(3AA).
