Defence Home Ownership Assistance Scheme Bill 2008

 

 

(Amendments to be moved by Mr Baldwin)

(1)     Clause 3, page 5, (after line 24), after the definition of service credit,

insert:

service-related death means a death that occurs in the course of or results from warlike service.

Note:          Warlike service is also defined in this section.

(2)     Clause 18, page 14 (after line 31), after subclause 1, insert:

          (1A)  Despite paragraph (1)(b), the Secretary must give a subsidy certificate to a surviving partner of a deceased partner who had a service-related death .

(3)     Clause 64, page 55 (table item 1), omit the table item, substitute:

The deceased partner:

 

(a) was a member of the Defence Force at the time of death; and

(b) died because of a compensable condition; and

(c) did not have a service-related death

The deceased partner is assumed to have become eligible as an incapacitated member (see section 9) at the time of death

The deceased partner:

(a) was a member of the Defence force at the time of death; and

(b) died because of a compensable condition; and

(c) had a service-related death

The deceased partner is assumed to:

(a) have had an accrued subsidy period of 300 months; and

(b) have undertaken effective service  for 20 years or more for the purpose of section 51
