Senator COLLETT - Inquest and trial.


Senator FRASER - Yes. Under this bill that will be obviated. One court will be set up to inquire into the circumstances, and those responsible will be dealt with by the same court; but the officer will not be deprived of the right of appeal to a higher court. Many functions are delegated to the Minister under the Navigation Act.


Senator McLeay - Since 1915 has a Minister been given power to override the decision of a court?


Senator FRASER (WESTERN AUSTRALIA) - It appears to me that the Leader of the Opposition does not understand the purpose of the bill, which is that one court shall investigate the circumstances of an accident and at the same time determine the sentence to be imposed upon the guilty party.
