Senator ABBOTT (New South Wales) . - In ordinary garnishee proceedings the court finds as a fact that a debt is owing by a third party ; in this instance does not- the Commissioner merely presume that the money is owing, whereas there may bc a dispute as to whether it is really owing.


Senator A J McLACHLAN (SOUTH AUSTRALIA) - If the Commissioner makes a mistake in that respect he has no power to recover; the money has to be due in actual fact.


Senator ABBOTT - That is the point
