Senator BRENNAN (Victoria) (Assistant Minister) . - I do not go so far as the honorable senator. In cases such as those suggested by him, the prosecution would be required to establish a prima facie case. The honorable senator will know that in some acts, the mere averment of the prosecution is prima facie evidence and the person charged is required to rebut the charge. I think that in the absence of the words " proof whereof shall lie upon him it would be impossible, in some instances, to establish a prima facie case.
