The CHAIRMAN - The time allotted for the consideration of the remainder of clause 23 has expired. The question now is, " That clause 23, as amended, and the further circulated amendment of the Government to the clause, be agreed to".

Circulated amendment of the Government -

At the end of the clause, add the following section: - " ' 24ac. - (1.) Proceedings for the commitment for trial of a person, or for the summary conviction of a person, in respect of an offence against any of the last three preceding sections shall not be instituted except by the Attorney-General or with the consent of the Attorney-General or of a person thereto authorized in writing by the Attorney-General. " ' (2.) Notwithstanding that consent has not been obtained as provided by the last preceding subsection -

(a)   a person may be arrested for an offence referred to in that sub-section; or

(b)   a warrant for the arrest of a person for such an offence may be issued and executed, and he may be charged, and may be remanded in custody or on bail, but -

(c)   no further proceedings shall be taken until that consent has been obtained; and

(d)   he shall be discharged if proceedings are not continued within a reasonable time.'.".


The CHAIRMAN - The question is, " That clause 23, as amended, and the further circulated amendment of the Government to the clause, be agreed to". Those in favour say, " Aye "; to the contrary, " No ". I think the " Ayes " have it.

Opposition Members. - The " Noes " have it.

Mr Ward - What happens to proposed new clause 23a? The time allotted for the consideration of it expired at 9.10 p.m.


The CHAIRMAN - The time will have expired.

The CHAIRMAN - The Standing Orders clearly provide for the procedure that has been adopted.
