Mr LYONS - The answers to the honorable member's questions are as follow : - 1 and 2. Yes.

3.   The tenure of the commissioners expired on the 10th August, 1020. 4, 5, and 6. The High Court held in the State of Now South Wales ti. the Commonwealth (20 C.L.R., 54) that Part V. of the Interstate Commission Act relating to the judicial powers of the commission was ultra vires the Parliament of the Commonwealth. In view of this decision it was, apparently, the view of the Government of tlie day that no useful purpose could he served by continuing the commission in existence. The appointment of commissioners to exercise tlie remaining powers of the commission under the act could not, in view of the financial position of the Commonwealth, be justified at the present time.
