The Senate, according to Order, resolved itself into Committee for the consideration of the Bills.

Ordered-That the Bills be considered in the following order:

Human Rights and Equal Opportunity Commission Bill 1985, Human Rights and Equal Opportunity Commission (Transitional Provisions and Consequential Amendments) Bill 1985, Australian Bill of Rights Bill 1985 and Human Rights and Equal Opportunity Commission Amendment Bill 1985.

Senator Durack, by leave, moved the following amendments together:

No. 1-Page 17, clause 23, at end of clause, add the following new sub-clause:

""(3) Without limiting the generality of the expression "reasonable excuse' in this section, it is hereby declared for the avoidance of doubt that it is a reasonable excuse for a person to refuse or fail to furnish information, produce a document or answer a question when required to do so under this Act, that the information, the production of the document or the answer to a question might tend to incriminate that person.''.

No. 2-Page 19, sub-clause 24 (3), leave out sub-paragraph (c) (iii) and paragraph (d).

Debate ensued.

Ordered-That the Question for the amendments be divided.

Question-That the words proposed to be added (amendment No. 1) be added-put and passed.

Senator Durack, by leave, amended amendment No. 2 to read as follows:

Page 19, sub-clause 24 (3), lines 13 to 18, leave out all words after paragraph (c).

Page 19, sub-clause 24 (5), lines 26 to 30, leave out the sub-clause.

Question-That the amendments be agreed to-put and passed.
