INSURANCE (AGENTS AND BROKERS) BILL 1981

The Senate, according to Order, resolved itself into Committee for the consideration of the Bill.

Senator Evans, by leave, moved the following amendments together:

Page 4, clause 10, sub-clause (1), leave out the sub-clause, insert the following sub-clause:

""(1) An insurer is responsible, as between the insurer and an insured or intending insured, for the conduct of his agent or employee, being conduct which--

(a) it was reasonable for the insured or intending insured in his circumstances to rely on; and

(b) was in fact relied on in good faith by the insured or intending insured, in relation to any matter relating to insurance and is so responsible notwithstanding that the agent or employee did not act within the scope of his authority or employment, respectively.''.

Page 14, clause 28, sub-clause (2), paragraph (a), leave out "", as soon as it is reasonably practicable,'', insert ""forthwith''.

Debate ensued.

Question--That the amendments be agreed to--put and passed.

Bill, as amended, agreed to.

Bill to be reported with amendments.

The Acting Deputy-President (Senator Coleman) resumed the Chair; and the Temporary Chairman of Committees (Senator Jessop) reported accordingly.

On the motion of Senator Evans the Report from the Committee was adopted.
