Senator BRANDIS (QueenslandAttorney-General, Vice-President of the Executive Council and Leader of the Government in the Senate) (12:43): Senator Ludlam, some metric or some basis had to be determined. It is better that that be an empirically verifiable basis. The proposal that, I understand, you are putting to me would involve a degree of judgement in relation to the circumstances of a particular business. So the reason that the government has legislated in this way is so that there can be some known and certain basis of discrimination.
