Senator ELLISON (Minister for Justice and Customs) (4:53 PM) —This amendment would allow a judge or AAT member who considers an emergency authorisation and does not approve it to order the destruction of information. That information could well be used in another operation and its destruction would be an undesirable outcome. I believe that the ability to use such information should be available even if that approval is not given. For that reason alone the government does not agree with the proposed amendment.
