Senator CHERRY (6:04 PM) —I move Democrat amendment (3) on sheet 2606:

(3) Schedule 1, page 3 (after line 3), after item 1, insert:

1A Subsection 3(1)

Insert:

indigenous means:

(a) a member of the Aboriginal race of Australia; or

(b) a descendant of the indigenous inhabitants of the Torres Strait Islands.

Amendment (3) is fairly simple. It seeks to insert a definition of `indigenous' into the act, which obviously feeds through to the amendment which the Senate has just passed. The definition follows normal jurisprudence, in terms of defining `indigenous' to cover a member of the Aboriginal race of Australia or a descendant of the indigenous inhabitants of the Torres Strait Islands. I think it is self-explanatory.
