Senator MURPHY (9:55 AM) —Minister, if the word `intentionally' did not appear in the bill in the form that it appears in these clauses—and I listened to what you said about the states not having the same application of the default provisions of the Criminal Code—would it not be the case then that the Commonwealth law would be the applicable law and that the default provisions of the Criminal Code and other prosecuting law would still apply to a person who was found, or at least alleged, to have committed an offence under this proposed legislation?
