Senator FAULKNER (Minister for the Environment, Sport and Territories) (11.56 a.m.) —When Mrs Kelly made the address that Senator Ian Macdonald is depending on she was talking about the whole package including the implementation. As I stressed in my earlier comments, this bill is the establishment bill and I think the difference is obvious. I stress that Mrs Kelly's comments referred to the development and the implementation of national environment protection measures; hence the nature of the comments that she made and hence the significant difference that I am pointing to in relation to the government's intention to embrace the principle of uniformity wherever it is sensible and possible to do so.

Senator FAULKNER (Minister for the Environment, Sport and Territories) (11.58 a.m.) —I move:

Clause 21, page 2, at the end of the clause, add the following subclause:

  "(3) In this section:

`national environment protection measure' includes a variation or revocation of such a measure.".

This particular matter relates to the policy intention that development, variation and revocation of national environment protection measures should be subject to the same processes. Clause 21 of the Commonwealth NEPC Bill as initially drafted provided only that development of NEPMs is subject to the Commonwealth disallowance procedure.

  Amendments to and revocations of NEPMs were not subject to the procedure. The proposed amendment to section 21 makes amendments to and revocations of NEPMs disallowable instruments in the Commonwealth parliament in the same way that the making of NEPMs are disallowable instruments. I commend this amendment to the Senate.
