Senator SHERRY (Parliamentary Secretary to the Minister for Primary Industries and Energy) (9.29 p.m.) —I partly covered this in summing up the second reading debate. Clause 73(1) states that the penalty is up to 500 penalty units. One penalty unit is $100, so the maximum penalty would be $50,000 and it obviously will be determined by the judge.

  That obviously allows the judge to determine what is an appropriate penalty, given the size of the infringement of the legislation. I would have thought that there may be cases where an infringement of the act could be a value greater than $50,000. Apparently a similar penalty is in the Copyright Act. It seems to me that there is some logic in having consistency with that act and that is the reason we have included this sort of penalty.
